The law was on the list of restricted players this season after being charged with manslaughter in the Dominican Republic.

The Veras Yakayra judge ruled Monday that there is insufficient evidence to prosecute Simon for an incident at a New Year celebration in which one person was killed and another injured.

No date for trial.

The reliever had a 4-2 mark with 17 saves and 4.93 ERA in 49 games with Baltimore last season.

Simon opened three games in Double A this month, but will use in the Baltimore bullpen.

The Orioles put on the disabled list 60 days infielder Cesar Izturis.
